Karnataka government has made registration of apartment owners' associations mandatory for apartment complexes and gated residential communities. It is meant to raise the standard of transparency in the government and improve accountability in the management of residential communities in the state.
Under the proposed framework, every eligible apartment and residential community will have a legally registered association that is responsible for the management of common facilities, maintenance charges, financial records and serving the interests of the communities. We aim to have a uniform system of governance that will help solve the problems of unregistered and informal associations as well.
Apartment owners' associations have a central role to play in the daily life of residential communities. They do maintenance of common areas such as parks, clubhouses, elevators, parking spaces, security systems, etc. The government aims to have these associations registered and legally recognized and these associations’ rights and responsibilities defined.
The mandatory registration will also ensure financial transparency. Registered associations will need to make sure they are keeping accounts, they will need to have regular audits (if necessary) and they will need to record maintenance collections and expenditures. That will build residents’ confidence and the money collected for maintenance will be spent precisely.
The other positive side effect of compulsory registration is better dispute resolution. A legal association that represents apartment owners in court and to government and utility companies and to the regulatory agencies can do that. It also provides a framework for the maintenance, ownership, common facilities and administration of apartments.
For apartment owners, the change should provide clarity of decision-making and governance. Elections, committee appointments, annual meetings, budgeting and policy decisions will be carried out in accordance with the legal framework for that matter (and in line with the local laws). It will reduce tension between residents and management committees and promote democratic engagement in residential life.
Existing apartment associations that are already functioning may need to review their registration status and ensure compliance with the latest legal requirements. Once the rules and implementation guidelines for the government are notified, they should start the registration process in line with the timelines.
Legal experts say the reform will benefit apartment owners and developers by creating a more transparent and accountable governance system. It is also expected to improve the maintenance of residential infrastructure and provide stronger legal backing for associations when dealing with civic agencies and service providers.
Residents, office bearers and developers should carefully review all notifications, rules and compliance requirements issued by the Karnataka government. They should also seek legal or compliance advice from professional lawyers if required, to ensure smooth transition and avoid any future penalty for non-compliance.
With apartment and residential community association registration mandatory, such a reform can be an important step towards modernizing community governance in Karnataka. The more housing there is in urban areas, the better the administration, the more accountable, and the more protection the apartment owners’ interests will be.
