Anthropic's Landmark $1.5 Billion Copyright Settlement Receives Final Court Approval

The world's largest AI copyright settlement has been approved by the courts and Anthropic is now the first to do so.

The class-action lawsuit was filed by authors and publishers who claimed Anthropic used pirated copies of their books without permission while developing and training its AI chatbot Claude. The case has been viewed as a landmark legal battle because it addresses how AI companies acquire and use copyrighted content for training large language models.

Although the court had previously ruled that training AI models on copyrighted books can be considered fair use under U.S. copyright law, Anthropic also violated copyright by downloading and storing millions of books from pirate websites in a central library. The settlement specifically resolves claims related to that unauthorized acquisition and storage of copyrighted works.

Under the agreement, authors and publishers covered by the settlement are to receive a total of about $3,000 per work in compensation across an estimated 500,000 copyrighted works. Anthropic said more than 91% of eligible authors and publishers have already claimed their payments, so the company can move toward closing the case.

The judge rejected objections that the settlement amount was too low, concluding that the agreement was a realistic outcome given the legal risks and uncertainty of continuing to trial. The court also approved attorney fees as part of the settlement process.

Despite the settlement, the overall legal debate surrounding AI and copyright is far from settled. Despite the fair use ruling being a victory for AI developers, a lot of authors and publishers are still pursuing legal action against Anthropic. AI training data lawsuits are also pending against other technology companies, and this case is a big deal.

In the future, the decision will influence AI companies in future talks with copyright holders to have licensing agreements and legal standards for the use of copyrighted material in AI development. As generative AI is being applied in more sectors of the industry, the balance between technological progress and creators’ rights is likely to remain one of the most closely watched legal issues in the sector.
